Examination of the client
Where a trustee is not satisfied with a client’s behaviour or they need more information, they can request the client or any other ’relevant person’ to come to a meeting to discuss the issue.
Where the client or other relevant person refuses or does not give the requested information, the trustee can apply to the courts for a hearing before a sheriff.
Failure to comply and attend can lead to a fine, a period of imprisonment of less than three months, or both.
