Award by the AiB
Bankruptcy, by whichever route is taken, is awarded by the AiB and advertised on the Register of Insolvencies.
There are exclusions from advertising if the client has a genuine reason for that information not to be made public. The AiB must agree that publication would likely jeopardise the client’s safety or welfare – eg, where they are fleeing an abusive relationship and do not want to be found. Apply by completing the ‘sensitivity obligation’ section on the application. The client may have to provide evidence – eg, a police report.
The AiB can refuse to award bankruptcy if it thinks the application is inappropriate or return it to the adviser if it thinks it is incomplete. The adviser then has 21 days to update the application, or it will be refused.
