You cannot receive ESA if you get jobseeker’s allowance. Additionally, you cannot receive ESA as well as state pension, maternity allowance, carer’s allowance, widowed parent’s allowance or unemployability supplement, as these are ‘overlapping benefits’. If you are entitled to more than one of these benefits, you are paid the one that is worth most.

You can get other benefits such as personal independence payment and industrial injuries disablement benefit without ESA being affected.

Employer-paid benefits – Statutory maternity pay, statutory adoption pay, statutory neonatal care pay and statutory shared parental pay also ‘overlap’ with ESA. Consequently, if you are entitled to ESA and claim one of these employer-paid benefits, you will receive whichever is the higher (which will usually be the employer-paid benefit).
