Financial Conduct Authority guidance
The FCA’s Consumer Credit Sourcebook sets out the legal framework in Scotland for safeguarding the welfare and managing the finances of adults who lack capacity due to mental disorder or inability to communicate.1CONC 2.10.2
Creditors should document the steps they take to assist people to make informed borrowing decisions and to ensure they make informed and responsible lending decisions.2CONC 2.10.12G The guidance recommends that creditors present clear, jargon-free information to explain credit agreements in user-friendly formats3CONC 2.10.14G and gives guidance on the treatment of customers with limited mental capacity.4CONC 7.10
