7. Key requirements and guidance
The Financial Conduct Authority (FCA) states that clients with limited mental capacity can be particularly vulnerable to detriment and requires that all organisations under its regulation establish clear and effective procedures to identify particularly vulnerable clients and support them appropriately.1CONC 8.2.7 This includes advice agencies.
The FCA position on mental capacity is informed by the Adults with Incapacity (Scotland) Act 2000.2CONC 2.10.2G It expects both creditors and advice agencies to comply with the law and its regulatory frameworks.
