Ancillary order
At the same time as applying for a time order, clients can apply for an ancillary order to reduce the level of interest being charged by the creditor.1s136 CCA 1974 If granted, it means the loan is paid off sooner.
Sheriffs are often reluctant to grant ancillary orders, even when the level of interest being paid is high. Creditors argue that they are justified in setting the interest rate high because the client is a high-risk customer. If the client can show that the interest is exorbitant or unfair, the courts may be more inclined to award an ancillary order.
