Liability for damage arising from faulty connection
If damage arises from a faulty connection (or reconnection), the energy company and/or its sub-contractor are liable. An energy company is liable for the negligence of its sub-contractor under a principle known as ‘vicarious liability’. Both the supplier and its sub-contractor could be treated as defendants in any claim, pleading the negligence of the sub-contractor and negligence on the part of the supplier in selecting an unsuitable sub-contractor.
