Making an application
An application can be accessed and submitted to the Account in Bankruptcy (AiB) through the Register of Insolvencies homepage.1roi.aib.gov.uk/roi/Moratoriums/Moratorium/Create Form 33 is used where the applicant is an individual person or the executor of a deceased person’s estate. Form 34 is used for entities – eg, partnerships or trusts.
Alternatively, the forms can be completed, signed, scanned and emailed to the AiB’s insolvency registrations team at moratorium@aib.gov.uk or posted to Moratorium Application, IRT, Accountant in Bankruptcy, 1 Pennyburn Road, Kilwinning KA13 6SA

If the moratorium is granted, the AiB registers this on the Register of Insolvencies and the DAS Register. From this date, the client thas six months to decide if they want to proceed with an application for a statutory debt option. During the six months, the creditors cannot commence diligence, serve a charge for payment or apply to the court for the client’s bankruptcy.
In most cases, the client can only apply for one statutory moratorium in a 12-month period.
