5. Test cases
There are no special rules
on
‘test cases’ (where your appeal may be affected by a matter of law that is under appeal in another case – see
Chapter 59(6) ). However, if your appeal may be affected by a test case, it can be put on pause, or
‘sisted’, until the test case has been decided. Your appeal can be sisted for other reasons, eg to allow more time for evidence to be gathered. If your appeal is sisted and you think that the sist should not apply, you can write to the tribunal, asking for it to be set aside and giving reasons for this.
