7. If your application is refused or Schedule 10 support is discontinued
If your application for Schedule 10 support is refused, or if you are in receipt of Schedule 10 support but your support is discontinued, you will not have a right of appeal to the Asylum Support Tribunal. Your only possible remedies are:
•to bring a claim for judicial review (see
here);
or •to make a further application for Schedule 10 support, in which you address the Home Office’s reasons for refusing your earlier application.
Generally, unless your application was refused for an obvious reason which can be clearly shown by the evidence, a judicial review claim should be considered first, since it can be extremely difficult to persuade the Home Office to change its mind without the threat of litigation.
