If you are appealing against a discontinuation of your section 4 support and you appeal within the time limits (or a late appeal is submitted and allowed to proceed by the tribunal) while you are still living in the section 4 accommodation, your support should continue until the day of the appeal. Although there is no equivalent written policy in respect of section 95, the Home Office’s practice is to permit all section 95 appellants to remain on support until their appeal is heard.
