Alternative dispute resolution
ADR involves an informal meeting where parties express their views in private and attempt to reach a mutually agreeable solution. This process is also known as ‘simple procedure mediation’. An independent mediator assists parties in identifying the issues and exploring possible resolutions. The mediator is not a decision maker; it is for the parties to decide on the terms of any agreement.
If mediation is successful, the court proceedings may be formally concluded without the need for any further input from the parties.
The majority of mediations are held face to face, but can be held by telephone or online. It should be noted that this can be expensive and depending on the outcome may increase court costs for all the parties involved.
