5. Does it affect other benefits?
The capital value of a vaccine damage payment held in a trust fund is disregarded for universal credit, income-related employment and support allowance (ESA), income support, income-based jobseeker’s allowance (JSA) and housing benefit. If the payment is not held in a trust fund, its capital value can be disregarded for up to 52 weeks from the date you receive it, to allow you time to set up a trust. After that it will be taken fully into account.
Any regular payments made from the trust fund
to or for the disabled person are disregarded for universal credit, income-related ESA, income support, income-based JSA and housing benefit. Other lump-sum payments will be treated as capital and will reduce benefit if the payments bring the total capital above the lower capital limit (see
Chapters 16(18) and
24(25)).
