3. If your partner is working
You are not entitled to income-based
JSA if your partner is in
‘remunerative work’ of (on average) 24 or more hours a week. Work counts if it is paid or done
‘in expectation of payment’. The rules closely follow the income support rules (see
Chapter 21(3)) and provide for specific circumstances in which work can be ignored or, conversely, in which your partner can be treated as working even when they’re not. If your partner’s work does not exclude you from entitlement, their earnings are taken into account in the assessment of your benefit (see
Chapter 24(4)-(6)).
