7. Treated as not having a limited capability for work-related activity
For ‘new style’ ESA, you are treated as not having a limited capability for work-related activity if in the six months before your ESA claim you had been found not to have a limited capability for work-related activity in a claim for universal credit. The DWP must be satisfied that:
■the universal credit decision was not based on an incorrect fact (see ‘Ground 6’ in
Box O.7 in Chapter 59);
and ■your physical or mental condition has not changed since then.
