2. Do you qualify?
To be entitled to income-related ESA, you must meet the basic qualifying conditions listed in Chapter 11(7) as well as all of the following conditions.
◦You must have no income, or your income is below your ‘applicable amount’ – see 6 below.
◦You must not have more than £16,000 in savings or capital (see Chapter 24(24)).
◦You must not be entitled to pension credit.
◦If you are one of a couple, your partner must not be claiming income-related ESA, pension credit, income support or income-based jobseeker’s allowance.
◦You must not be in remunerative work (see 3 below).
◦If you are one of a couple, your partner must not be working for 24 hours or more a week (see 3 below).
You must not be subject to immigration control (see Chapter 55(2)) and must satisfy the habitual residence test (see Chapter 55(4)).
