3. Exempted payments

Some compensation payments are exempt from the recovery rules. They are:

■vaccine damage payments;

■Criminal Injuries Compensation scheme payments (but see Chapter 45(3) );

■payments from the Macfarlane and Eileen Trusts, MFET Ltd, the Caxton Foundation and the Skipton Fund;

■payments from an approved blood scheme;

■payments from an approved Thalidomide relief and assistance trust;

■payments from the UK Asbestos and EL Scheme Trusts;

■payments from the government-funded trust for people with variant Creutzfeldt-Jakob disease;

■payments from the London Bombings Relief Charitable Fund;

■payments under the Fatal Accidents Act 1976;

■contractual sick pay from an employer;

■payments from the NHS Industrial Injuries scheme;

■payments made to the injured person by an insurer under the terms of an insurance contract agreed before:

-the date on which the injured person first claims a recoverable benefit in consequence of the disease in question; or

-the occurrence of the accident or inj
