Liability for damage arising from faulty connection
If damage arises from a faulty connection (or reconnection), the energy company and/or its sub contractor are liable. An energy company is liable for the negligence of its sub contractor under a principle known as ‘vicarious liability’. Both the supplier and its sub contractor could be treated as defendants in any claim, pleading the negligence of the sub contractor and negligence on the part of the supplier in selecting an unsuitable sub contractor.
