2. Do you qualify?
To be entitled to income-related ESA,
you must meet the basic qualifying conditions listed in
Chapter 11(7) as well as all of the following conditions.
•You must have no income, or your income is below your ‘applicable amount’ – see
6 below .
•You must not have
more than £16,000 in savings or capital (see Chapter
24(24) ).
•You must not be entitled to pension credit.
•If you are one of a couple, your partner must not be claiming income-related ESA, pension credit, income support or income-based jobseeker’s allowance.
•You must not be in remunerative work (see
3 below ).
•If you are one of a couple, your partner must not be working for 24 hours or more a week (see
3 below ).
•You must not be in full-time education (see
4 below ).

You must not be subject to immigration control (see
Chapter 55(2) ) and must satisfy the habitual residence test (see
Chapter 55(4) ).
