4. Test cases
There are no special rules on
‘test cases’ (where your appeal may be affected by a matter of law that is under appeal in another case – see Chapter 59(6)). However, if your appeal may be affected by a test case, it can be put on pause, or
‘sisted’, until the test case has been decided. Your appeal can be sisted for other reasons, eg to allow more time for evidence to be gathered. You can write to the tribunal, asking for the sist to be set aside, if you consider that it should not apply to you.
