•If you are too disabled or ill to be expected to work, you may be entitled to benefit and national insurance credits on the basis of having ‘limited capability for work’. The main benefits this affects are universal credit and employment and support allowance.
•Whether or not you have limited capability for work is assessed by a ‘work capability assessment’. This also tests whether you have ‘limited capability for work-related activity’. If so, you are not required to attend work-focused interviews or prepare to return to work, and are entitled to a higher amount of benefit.
•If you work, you may be regarded as not having limited capability for work or work-related activity.
•If you disagree with the decision about your limited capability for work or work-related activity, you can apply for a revision or supersession (see
Chapter 56), or appeal against it (see
Chapter 57).
