    Some people who are defined as a ‘person subject to immigration control’ are not excluded from claiming the benefits and tax credits on here because they are in an exempt group. These exempt groups vary between the different categories of benefits and tax credits, so being exempt for one category does not necessarily mean you can receive a benefit in a different category.
    Note: if your leave prohibits you from having recourse to public funds (see here), you can still claim any benefit (but not council tax reduction) to which you are entitled on the basis of being in an exempt group, even though these benefits (except adult disability payment (ADP), child disability payment (CDP), funeral support payment, employment and support allowance (ESA) in youth and incapacity benefit (IB) in youth) are defined as ‘public funds’. This is because the Immigration Rules do not regard you as having recourse to public funds if you are entitled
